1. Acceptance of Terms
TerritoryIQ is a service of Hilbert Systems LLP ("TerritoryIQ," "we," "us"). By accessing or using the TerritoryIQ platform, site, databases, or generated reports (collectively, the "Service"), you agree to be bound by these Terms of Service on behalf of yourself and the company you represent ("Customer," "you"). If you do not agree to these terms, you are prohibited from accessing or using the Service.
2. Description of Service
TerritoryIQ provides property-level analytics, opportunity scoring, and storm-exposure intelligence to roofing contractors and related trade professionals, built from public government records, open geospatial and weather datasets, and our own proprietary modeling.
The Service is not, and may not be used or represented as:
- a consumer report under the Fair Credit Reporting Act;
- a roof inspection, home inspection, engineering report, appraisal, or survey;
- an insurance claim determination, coverage opinion, or public-adjuster service;
- a homeowner contact list, or a grant of consent to contact any person; or
- an official government record — the Service is not endorsed, certified, sponsored, or approved by any county, state, or federal agency, or by NOAA or the U.S. Census Bureau.
3. Report Types and Limitations
We offer, or are preparing to offer, the following report types:
- Property Report — a report on a single, specifically requested property, which may include a public-record owner name.
- Property/Territory Bundle — a ranked list of properties within a ZIP code or territory for research and canvassing prioritization. Bundles do not include owner names, phone numbers, or email addresses.
- Storm Report — a report ranking properties by modeled storm exposure within a Customer's registered territory following a storm event.
Scores and rankings in every report reflect property-level opportunity and exposure signals only. They are estimates based on available data and modeling assumptions; they are not statements about any individual owner or resident, and a higher score or ranking does not confirm that a property has storm damage, needs a new roof, is for sale, or will result in a sale. Properties in a Bundle or Storm Report are not exclusive leads unless separately agreed in writing.
4. License and Scope of Use
Subject to these Terms, we grant Customer a limited, non-exclusive, non-transferable, and revocable license to use purchased reports solely for Customer's internal business research, territory planning, inspection prioritization, and lawful marketing and canvassing planning.
Customer may not resell, sublicense, publish, post publicly, scrape, redistribute, or use reports or scores to build a competing database, lead service, or scoring product.
5. No Consumer Report; No Eligibility Use
Customer shall not use any report, score, or indicator as a consumer report, or for credit, insurance underwriting, employment, housing, tenant screening, lending, debt collection, public-benefits eligibility, or any similar eligibility or investigative purpose.
6. Ownership and Occupancy Data Restrictions
Owner name, where included in a Property Report, is drawn from a public government record, may be incomplete or out of date, and does not confirm current ownership, residency, decision-making authority, or consent to be contacted.
Any owner-occupancy or ownership-status indicator is either a summary of an underlying public record or a modeled, unverified estimate, and may not be used for insurance underwriting, occupancy verification, lending, tenant screening, or fraud investigation.
Customer may not use any report to discriminate or target outreach based on race, color, religion, national origin, sex, familial status, disability, age, marital status, veteran status, income source, health, or any other protected or sensitive characteristic.
7. Customer Responsibility for Outreach and Compliance
Customer is solely responsible for all outreach, marketing, calling, texting, emailing, direct mail, door-to-door canvassing, and sales activity conducted using our reports, and for compliance with all applicable federal, state, and local law governing that activity, including but not limited to the Telephone Consumer Protection Act, National and internal Do-Not-Call requirements, the CAN-SPAM Act, state and local canvassing and solicitation permitting, home-improvement contract law, and insurance-related advertising restrictions.
TerritoryIQ does not provide, and no report should be understood to provide, consent to call, text, email, visit, or otherwise contact any person. TerritoryIQ is not liable for municipal code violations or other regulatory consequences arising from Customer's field operations.
8. No Insurance Advice or Public-Adjuster Conduct
Customer may not use any report to represent to a homeowner that roof or storm damage has been confirmed, that an insurance claim is covered, that an insurer will pay for repairs, or that a deductible can be waived, and may not act as a public adjuster in connection with any report unless properly licensed and legally permitted to do so.
9. Prohibited Activities on the Platform
When using our site or reports, you must not:
- Use automated scripts, bots, scrapers, or tools to harvest property records or heatmaps from the site.
- Circumvent rate limits, access controls, or user authentication protocols.
- Introduce malicious software or attempt to disrupt the performance of our database systems.
- Share corporate API keys or credential profiles outside of your registered team members.
10. Data Accuracy; Disclaimer of Warranties
Reports are compiled from public government records, open datasets, and proprietary modeling, and are provided "as is" and "as available," without warranty of any kind, express or implied, including as to accuracy, completeness, currency, property condition, roof condition, storm damage, or claim eligibility. Source records may change or be corrected after a report is generated. Customer is responsible for independently verifying any information material to a business decision.
11. Suppression and Restricted-Address Compliance
If we notify Customer that a property or owner has been suppressed from our reports — including because an address is restricted under Indiana law (IC 36-1-8.5) or a comparable law — Customer must immediately cease any further outreach based on previously delivered reports concerning that property and delete any retained copies of the suppressed information from its own systems.
12. Indemnification
Customer shall indemnify and hold TerritoryIQ harmless from claims, damages, and expenses arising from Customer's outreach, marketing, canvassing, sales practices, insurance-related representations, home-improvement contracts, regulatory violations, or other misuse of our reports.
13. Limitation of Liability; Termination
To the maximum extent permitted by law, TerritoryIQ's aggregate liability arising from these Terms or the Service is limited to the fees Customer paid in the twelve months preceding the claim. We may suspend or terminate a Customer's access if we reasonably believe the Customer has violated these Terms or applicable law, or created regulatory or reputational risk for TerritoryIQ.
14. Governing Law
These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-laws principles.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last Updated" date at the top of this page. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
